Connect3 has created this Acceptable Use Policy ("AUP") to ensure the responsible, fair and reasonable use of Vonage Business networks, services, systems, websites and products (collectively, the "Connect3 Products and Services") by our customers and other Connect3Products and Services users (collectively, the "User(s)"), and to enable Connect3 to provide Users with reliable, secure and efficient services. By contracting or using the Connect3 Products and Services, in addition to any other agreements Users have entered into with Vonage Business, Users agree to be bound by the terms of this AUP. Connect3 reserves the right to modify this AUP at any time and in its sole discretion, and such modifications will be effective when published. Any use of the Connect3 Products and Services after such modification constitutes acceptance of the AUP as revised. Termination / Suspension
Any user that Connect3 determines to have violated any element of this Acceptable Use Policy (AUP) may be subject to suspension or termination of service, with or without notice. Connect3 has the right, but not the obligation, to take additional action, as Connect3 determines that it is appropriate under the circumstances to eliminate or prevent repeated violations. Connect3 shall not be liable for damages of any kind suffered by a User or a third party, resulting in all or part of Connect3's exercise of its rights under this AUP.
Prohibited Conduct
Connect3 products and services should be used only for legal purposes and in a manner consistent with the intended purpose of Connect3 products and services. Users must not use the Connect3 Products and Services to distribute, transmit, publish, receive, use or store any material:
- In violation of any local, state or federal law and regulation;
- That can expose Connect3 to criminal liability; or
- That may adversely affect Connect3 Products and Services or other Connect3 Customers or Users.
In addition, users are prohibited from facilitating the violation of any of these UPA and violating or facilitating the violation of another supplier's AUP, including the distribution, transmission, publication, receipt, use, storage or supply of any other product or service that violates this AUP or other AUP from the supplier. Each time a User accesses another provider or network using the Connect3 Products and Services, that User must comply with the rules and policies of the provider or network. You agree to indemnify, defend and remove Connect3 from all claims, damages, losses and expenses (including attorneys' fees and expenses) resulting from or allegedly resulting from the access or use of such users from other providers or networks.
Inappropriate Content
Users should not use the Connect3 Products and Services to distribute, transmit, publish, receive, use or store inappropriate material, as reasonably determined by Connect3, or material that is obscene (including child pornography), defamatory, defamatory, threatening, abusive, hateful or excessively violent.
Harmful Content
Users must not use the Connect3 Products and Services to distribute, transmit, publish, receive, use, or store material that may be harmful or interfere with Connect3 Products and Services or third-party systems, networks, websites, or services. Such prohibited content includes, but is not less, worms, viruses, or Trojans.
Fraudulent or Deceptive Content
Users must not use the Connect3 Products and Services to distribute, transmit, post, receive, use or store material containing fraudulent offers of products or services, or any advertising or promotional material containing misleading, false or misleading statements, representations or claims. Users are prohibited from submitting false or inaccurate data on any online order form, contract or request, including fraudulent use of credit cards.
Email / Unsolicited Messages
Users should not use the Connect3 Products and Services to transmit unsolicited e-mail messages, including but notably unsolicited bulk mail, in which such emails could reasonably be expected to cause complaints ("spam"). Users are prohibited from using another provider's services to distribute spam or to promote a site hosted or connected to Connect3 Products and Services. Users should not use Connect3 products and services to:
- Send emails that are excessive or intended to harass others;
- Continue sending emails to a recipient who has indicated that the recipient does not want to receive them;
- Send email with fake TCP/IP packet header information;
- Send malicious emails, including "mail bombings";
- Send or receive emails in a way that violates any other provider's policies; or
- Use an email mailbox exclusively as data storage space.
Intellectual Property
Material accessible through the Connect3 Products and Services may be subject to protection under advertising, privacy or other personal and intellectual property rights. Such rights include, but are not to be, copyrights, patents, trade secrets, trademarks or other property information. Users must not use the Connect3 Products and Services in any manner that may violate, dilute, embezzle or violate such rights. Users should not use a domain name in connection with the Connect3 Products and Services and should not use that domain name in violation of the trademark, service mark, or other rights of third parties.
Third Party Rules
Users may have access through Connect3 Products and Services to search engines, chat rooms, ad boards, web pages and services or other services that publish rules, guidelines, or agreements to regulate their use. Users must comply with such rules, guidelines or agreements.
Inappropriate Actions
Users should not use the Connect3 Products and Services to engage in activities that may be harmful or interfere with Connect3 Products and Services or third-party networks, systems, services, or websites. This includes, but is not limited to, mail bombing, flooding, or denial-of-service attacks. Users are prohibited from violating or attempting to violate the security of Connect3 Products and Services, or third-party computers, accounts or networks. Users are prohibited from performing any activity considered a precursor to security breach attempts, including any form of polling, scanning, or other proof of information collection activity. Inappropriate activity may result in civil or criminal liability. Connect3 will investigate such activity and may involve and cooperate with law enforcement authorities in prosecuting users involved in such activity.
Responsibility for Content
Connect3 assumes no responsibility for any material created or accessible through the Connect3 Products and Services. Connect3 is not obligated to monitor or exercise any editorial control over such material, but reserves the right to do so. In the event that Connect3 becomes realized that such material may violate this AUP or expose Connect3 to civil or criminal liability, Connect3 reserves the right to block access to such material and suspend or cancel any User who creates, stores or disseminates such material. Connect3 further reserves the right to cooperate with legal authorities and third parties in the investigation of alleged irregularities, including disclosure of the Identity of the User that Connect3 holds responsible for irregularities.
Fair and Reasonable Use
Connect3 wants users to understand the intended and permitted uses of Connect3 products and services, and wants to prevent fraud, exploitation, and abuse of certain Connect3 calling plans and features. Certain calling plans, including unlimited calling plans, are designed for normal commercial use and are not intended to represent typical use of single organizations.
